Corrective VAT returns in France: fixing a mistake or omission
Filed a VAT return that was inaccurate or incomplete? Correcting it voluntarily is often better than waiting for an audit. Here is how to correct, when a claim is needed and what Hanoutax does under a mandate.
Correcting a return: the principle
A corrective return replaces the original return for the same period. It can fix a taxable base, a rate applied, deductible VAT left out or an omitted operation. The error can favour the business (too much VAT paid) or the State (too little), and the mechanism differs between the two.
Related filings can be corrected too: the VAT recapitulative statement, the DES, OSS returns. Each channel has its own procedure; this page deals with the periodic VAT return (CA3 and CA12).
How to correct online
According to impots.gouv.fr (French), the correction is made in the business account, “Déclarer TVA” menu, by filing a corrective return for the same period. It cancels and replaces the previous one, but payments already made are not changed. What follows depends on the direction of the correction:
| Situation | What to do | Claim needed? |
|---|---|---|
| Corrected VAT higher than the amount already paid | Pay only the difference, using “Modifier le montant” in “Payer TVA” | No |
| Corrected VAT lower than the amount already paid | Do not pay anything more; ask for the overpayment to be refunded | Yes, through the tax office’s secure messaging, “Réclamation sur la TVA et taxes annexes” |
| VAT credit found afterwards | See the page on VAT credit refund | Depends |
Right to make an error, late-payment interest and penalties
The right to make an error (droit à l’erreur) lets a business regularise its position without a penalty when the inaccuracy or omission is unintentional and the original return was filed on time. The authorities state that it does not apply to late filing, late payment or deliberate errors.
- Voluntary correction (before any audit): late-payment interest is cut by 50%, i.e. 1.2% a year instead of 2.4%.
- Correction during an audit: interest reduced by 30%.
- Bad faith: no right to make an error.
These rules are as stated by the authorities; how they apply depends on each file. Our article on penalties, late-payment interest and surcharges covers the cases.
Steps of a regularisation
Common mistakes
- filing a second return as a supplement when it replaces the first;
- paying the whole corrected amount instead of just the difference;
- forgetting the claim when the correction reduces the VAT due;
- correcting only the VAT without amending the matching recapitulative statement or DES;
- waiting for an audit, which forfeits the interest reduction available for voluntary correction.
Hanoutax’s role under a mandate
Hanoutax, a VAT agent (mandataire fiscal) acting under a written mandate, analyses the error, measures its impact, files the corrective return, prepares the claim if one is needed and follows the exchanges with the tax office. We commit to no outcome on penalties or processing times. See also notices and deadlines follow-up and our article on common tax mistakes of foreign companies.
FAQ
How do I correct a VAT return already filed?
By filing a corrective return for the same period from the business account (“Déclarer TVA” menu). It cancels and replaces the previous one.
Do I have to make a claim?
Only if the corrected VAT is lower than what you already paid: the claim is made through secure messaging. If it is higher, you pay the difference.
Are there penalties if I correct it myself?
According to the authorities, the right to make an error allows regularisation without penalty for an unintentional error on a return filed on time; reduced late-payment interest remains due. Each file is reviewed individually.
Can a recapitulative statement or DES be corrected?
Yes, they are also amended, under their own procedure on the customs online service.
Can I correct a return from an earlier period?
In principle yes, but the time limits and consequences depend on the period and the situation; we analyse them case by case.
Can Hanoutax handle the correction for me?
Yes, under the written mandate.
